By accessing or using the Windshield Wingman website at windshieldwingman.com (the "Site") or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or Services.

These Terms apply to all visitors, users, and others who access or use the Services. By using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Services

Windshield Wingman provides an AI-powered marketing and operations platform built exclusively for windshield repair and replacement shops. Our Services include, but are not limited to:

• Automated missed-call and 24-hour text response
• Calibration troubleshooting assistance
• Automated sales upsell and review request workflows
• Call and text analysis
• Social media marketing post generation
• Google and GLSA ad campaign management
• Appointment reminders and scheduling support

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. User Responsibilities

By using our Services, you agree to:

• Provide accurate, current, and complete information when requested
• Use the Services only for lawful purposes and in accordance with these Terms
• Not use the Services to transmit any unlawful, harmful, threatening, abusive, or otherwise objectionable content
• Not attempt to gain unauthorized access to any part of the Services or related systems
• Comply with all applicable federal, state, and local laws, including those governing telecommunications and marketing communications

4. No Long-Term Contracts / Cancellation

Windshield Wingman does not require long-term contracts. Service agreements are month-to-month unless otherwise specified in a separate written agreement between you and Windshield Wingman.

You may cancel your subscription or service at any time by contacting us at [email protected] or by calling 813-648-1644. Cancellations take effect at the end of the current billing period unless otherwise agreed.

5. Intellectual Property

All content on the Site and within the Services — including text, graphics, logos, images, software, and other materials — is the property of Windshield Wingman or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Services without our prior written consent.

7. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WINDSHIELD WINGMAN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WINDSHIELD WINGMAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

8. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the bottom of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in Hillsborough County (Tampa), Florida.
